1. Acceptance of Terms

By accessing or using Fairway ETA ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Fairway ETA provides maritime voyage planning tools including ETA calculation, route optimization, fuel cost analysis, maritime market data, and industry partner directory services. The Service is available via web browser at fairwayeta.com.

3. Disclaimer of Accuracy

IMPORTANT: All calculations, market data, bunker prices, freight indices, and other information provided by Fairway ETA are for reference and planning purposes only. They should not be used as the sole basis for commercial decisions. Actual voyage times, fuel consumption, canal fees, and costs may vary significantly from estimates.

Market data including bunker prices, BDI indices, crude oil prices, and currency rates are indicative only and may not reflect real-time market conditions. Users should verify all data with official sources before making commercial decisions.

4. User Responsibilities

You agree to: use the Service only for lawful purposes, not attempt to reverse-engineer or copy the Service, not scrape or harvest data from the Service, provide accurate information when registering as a partner, and comply with all applicable maritime and trade regulations.

5. Partner Services

Partners listed on our platform are independent businesses. Fairway ETA does not endorse, guarantee, or assume responsibility for any partner's services, products, or business practices. Partner listings are paid advertisements and do not constitute recommendations.

6. Crowdsourced Data

If you submit bunker pricing or other market data to our platform: you confirm you have the right to share such data, the data will be anonymized and aggregated, individual submissions will not be publicly attributed, and Fairway ETA may use the aggregated data to improve our services.

7. Intellectual Property

All content, design, algorithms, and data compilations on Fairway ETA are protected by intellectual property laws. The ETA calculation engine, route optimization algorithms, and data presentation formats are proprietary to Fairway ETA.

8. Payment Terms

Partner registration fees and subscription services are billed through Stripe. All fees are in USD unless otherwise stated. Refunds are available within 14 days of initial payment. Subscriptions auto-renew unless cancelled before the renewal date.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAIRWAY ETA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea. Any disputes shall be subject to the exclusive jurisdiction of the courts of Busan, Republic of Korea.

11. Modifications

We reserve the right to modify these Terms at any time. Continued use of the Service after modifications constitutes acceptance of the updated Terms.
